About Us
The Mental Health Review Board (East Khasi Hills, West Khasi Hills, South West Khasi Hills) was constituted in Meghalaya on 13/4/2022 to help protect the rights of individuals under the Mental Health care Act 2017. Any person held involuntarily who wishes to appeal a decision made by their doctor can apply to the Board for a hearing. Others can also apply to the Board on the patient’s behalf. Other Functions are :
- To register, review, alter, modify or cancel an advance directive;
- To appoint a nominated representative;
- To receive and decide application from a person with mental illness or his nominated representative or any other interested person against the decision of medical officer or mental health professional in charge of mental health establishment.
- To receive and decide applications in respect non-disclosure of information.
- To adjudicate complaints regarding deficiencies in care and services.
- To visit and inspect prison or jails and seek clarifications from the medical officer in-charge of health services in such prison or jail

What is the role of the Mental Health Review Board?
The Mental Health Review Board is an independent, statutory body responsible for reviewing the detention of patients in designated centres.
Patients are referred to designated centres arising from a decision by the courts that they are unfit to be tried or, having been found not guilty of an offence by reason of insanity.

Who sits on the Board?
8 members currently sit on the Board to review the detention of a patient. A Chairperson, who has to be a judge or former judge of the District and Session Court, Psychiatrist, Medical Officer, Additional Deputy Commissioner, Extra Assistant Commissioner, NGOs, Caregiver.

Who appoints the members of the Review Board?
The appointment of Chairperson and members of every Board shall be made by the Chairperson of the State Mental Health Authority.

Who can attend Review Board hearings?
The patient* and legal representative
Witnesses called by the Board or by the patient.
* A patient shall not be required to attend before the Review Board if, in the opinion of the Board, such attendance might be prejudicial to their mental health, well-being or emotional condition.

How often are patients assessed?
The Act provides that the Board shall review admission of minor patients within 7 days after being informed and after every subsequent 30 days. The same goes for supported admission.
Decisions of the Board are given where reasonably possible within 5 working days.

Where are Board Hearings heard?
Generally, Board meetings/ HEARING take place in the Mental Hospital.
